In the early hours of October 13, 2012, Tonye Bowens, an FDOT Road Ranger, was clearing the scene of an accident on I-95. In the early hours of October 13, 2012, Tonye Bowens, an FDOT Road Ranger, was clearing the scene of an accident on I-95. Casablanca East & 3342 Social Club.

In the early hours of October 13, 2012, Tonye Bowens, an FDOT Road Ranger, was clearing the scene of an accident on I-95. A drunk driver, exiting her shift as a dancer at Cheetah Gentlemen’s Club, plowed through the accident scene, striking Mr. Bowens, literally knocking him from his shoes. The driver’s blood alcohol level was twice the legal limit.  Mr. Bowens was hospitalized for months for his injuries.

“This was the most difficult case I’ve litigated in my entire career,” stated Jason Weisser.

The obstacles encountered throughout the litigation process were formidable, including:

  • Bankrupt Insurance Company
  • Reliability Challenges with Witnesses
  • Complex Employment Liability Issues
  • Destruction of Crucial Evidence
  • Expired Statute of Limitations
  • Pioneering Vicarious Liability Claims

  • Determining Employer Responsibility for Intoxicated Employee

Despite these adversities, on the second day of jury selection, Mr. Weisser and his legal team successfully settled the claim for $2.5 million paid for by the club owners, out of pocket. The offer to settle by the Defendants was the first settlement discussion in over 3,660 days. The case settled 10 years and two weeks from the fateful day of the accident.

The award will be presented during the Florida Justice Association Founders Awards Luncheon held on Thursday, September 19, 2024, at the Four Seasons Resort Orlando at Walt Disney World Resort, 10100 Dream Tree Blvd., Lake Buena Vista, FL 32836.
